The purpose of the report is to seek approval
to vary a clause in the lease dated 25th March 2004 for a term of
999 years granted between Oldham Council and Tweedale Developments
Limited.
The long lease reserves a right of entry on to the property to
construct, repair and maintain service media. The variation to this
clause provides that the right to enter and the right to carry out
any works can only be carried out upon any unbuilt parts of the
property and that the
freeholder cannot connect into any new service media constructed by
the tenant.
The variation will enable Tweedale Developments to grant an
underlease of part of their property for use as an Urban Reserve
Electricity Generating/Storage unit.
