Information about Licensing Committee

The Licensing Committee will carry out these tasks:

 

Functions under the Licensing Act:

·         Deciding on applications for Club Premises Certificates (for alcohol and entertainment) and Premises Licences (for alcohol, entertainment, and late-night food), including changes, transfers, provisional statements, or reinstatements, when relevant objections are made and not withdrawn.

·         Deciding on reviews and summary reviews of Club Premises Certificates and Premises Licences unless all parties come to an agreement, and a hearing is not needed.

·         Deciding to object to a Club Premises Certificate, Premises Licence, or other relevant application under the law when the local authority is a consultee but not the main authority.

·         Withdrawing a Club Premises Certificate (for alcohol and entertainment) if the club is no longer a qualifying club.

·         Deciding on applications for new Personal Licences (for alcohol) when relevant objections are made and not withdrawn.

·         Deciding on reviews of Personal Licences.

·         Deciding on applications to change a Designated Premises Supervisor when a relevant objection is received.

·         Deciding on applications for an Interim Authority when a relevant objection is received.

·         Deciding on serving a notice for a Temporary Event Notice when a relevant objection is received.

Functions under the Gambling Act:

·         Deciding on applications for changes or transfers of licenses for Adult Gaming Centres, Betting, Bingo, Family Entertainment Centres, and Track Betting, or provisional statements and reinstatement of licenses, when relevant objections are received and not withdrawn.

·         Deciding on applications for changes or transfers of Club Premises Certificates (for alcohol and entertainment) or provisional statements and reinstatement of licenses, when relevant objections are received and not withdrawn.

·         Reviewing licenses for Adult Gaming Centres, Betting, Bingo, Family Entertainment Centres, and Track Betting, as well as Club Premises Certificates (for alcohol and entertainment), unless all parties agree and a hearing is not needed.

·         Deciding to object to applications for licenses for Adult Gaming Centres, Betting, Bingo, and Family Entertainment Centres when the local authority is a consultee but not the main authority.

·         Deciding on applications and renewals for Club Gaming and Club Gaming Machines Permits when relevant objections are received.

·         Withdrawing a Club Premises Certificate (for alcohol and entertainment) if the club is no longer a qualifying club.

·         Cancelling Club Gaming Permits.

·         Cancelling or removing authorization for a Licensed Premises Gaming Machine permit.

·         Deciding on objections related to an Occasional Use Notice (gambling) or a Temporary Use Notice (gambling).

·         Revoking the registration of Small Society Lotteries.

Functions under the Local Government (Miscellaneous Provisions) Act:

·         Deciding on applications or renewals for a Hackney Carriage/Private Hire Driver’s Licence when the relevant Officer refers them, especially if there are any convictions, cautions, warnings, ASBOs, or other relevant information based on the Council’s guidelines.

·         Reviewing Hackney Carriage/Private Hire Driver’s Licences, except for suspensions or revocations in urgent situations related to offences, investigations, or conduct before a full review.

·         Deciding on applications and renewals for a Private Hire Operator’s Licence when the relevant Officer refers them, particularly if the applicant has unspent convictions that would make them unsuitable or if deemed inappropriate by the Officer.

·         Reviewing Private Hire Operators Licences.

·         Deciding on applications or renewals for a Hackney Carriage/Private Hire Vehicle licence when the relevant Officer refers them.

·         Reviewing Hackney Carriage/Private Hire vehicle licences.

Any further functions relating to licensing or registration:

·         Granting, renewing, refusing, changing, suspending, cancelling, or revoking any license, registration, or permission.

·         Any matters that are specifically assigned to another Committee or Panel.

The Licensing Committee can set rules about how licensing matters are handled, the behaviour of license holders, and the technical requirements for licensed premises and vehicles, as long as it is allowed by law and after consulting any necessary parties or those it thinks are relevant.

The Licensing Committee may periodically receive reports on how its work affects culture, the economy, and tourism. As required by law or as it sees fit, it may also report its activities to other Council or Executive bodies.
