RESOLVED that the minutes of the meeting of the Charitable Trust Committee held on 5th September 2019 be approved as a correct record.

Former DSO Building, Adjoining Land & Public Convenience Block, High Crompton Park, Rochdale Road, Shaw. pdf icon PDF 395 KB

Minutes:

Consideration was given to a report of the Senior Consultant Surveyor which provided the Committee with an update in respect of the application to the Charity Commission for an Order permitting the disposal of the subject land to the Council as a connected person.

 

Further to Minute 6 of the meeting held on 26 November 2018 and Minute 8 of the meeting held on 13 June 2019, an application had been made to the Charity Commission for an Order for the disposal of the subject land to the Council as a connected person. The Charity Commission had made some preliminary requisitions and subsequently drafted the Order permitting the land swap. The draft order was appended to the report at Appendix 2.

 

The Committee was requested to consider and approve the Order as drafted, so that the purchaser of the DSO building could complete the renovation works to the building, in order to open the premises as a Café/Eatery for the benefit of the general public.

 

Options/alternatives considered:

1.     Approve the draft Order

2.     Do not approved tthe draft Order

 

RESOLVED that approval be given to the draft Order provided by the Charity Commission, appended to the report at Appendix 2.

William Hague Trust - Update on the sale of the Hollies, Frederick Street, Werneth pdf icon PDF 161 KB

Minutes:

Consideration was given to a report of the Principal Regeneration Officer which provided the Committee with an update on the sale of ‘The Hollies’, Frederick Street, Werneth.

 

Further to Minute 10 of the meeting held on 5 September 2018 and Minute 8 of the meeting held on 26 November 2018, an Agreement for Sale was completed on 21 December 2018 and the first payment (£93,000) had been made. Greenstone had confirmed that they were ready to make the second payment (£183,000) on time.

 

They had requested an extension of time for a further 6 months to make the final payment, from 21 June 2020 to 21 December 2020. They stated this was because of unforeseen issues on another site they were developing in Royton. That project had stalled due to delays in an application for funding from the Greater Manchester Housing Investment Fund which had a knock-on effect for their plans for The Hollies..

 

Options/alternatives considered:

1.     Continue with the sale of the land to Greenstone Construction Ltd and grant an extension of time until 21 December 2020. This option would only be given if Greenstone paid the money due on 21 December 2019 on time.

2.     Do not grant an extension of time. If Greenstone did not make the final payment, then the legal contract would be terminated. Greenstone would lose £93,000 and also the second payment of £183,000 (should this be received).

 

RESOLVED that the sale of the land to Greenstone Construction Ltd be continued and an extension of time until 21st December 2020 be granted for the final payment, subject to the second payment, due on 21st December 2019, being made on time.

Werneth Youth Centre Asset 220 (Werneth Ward) pdf icon PDF 70 KB

Minutes:

The Committee gave consideration to a report of the Deputy Chief Executive which provided them with an update with regards to Werneth Youth Centre.

 

Members were informed that, on 11th September 2019, the Charity Commission had granted a Cy Pres Scheme and an Order for the sale of the premises known as 146 Werneth Park Road.

 

The Committee noted the new objects of the charity, as set out in the report.

 

The Committee was informed that officers had obtained a valuation of the premises and had prepared a formal notice under section 121 the Act to advertise the proposed sale in a newspaper circulating in the area. The notice Invited representations from members of the public.

 

Once the notice period of one month had expired, the officers would advertise the premises for sale in accordance with the recommendations of the independent surveyor. Members noted that the property could not be sold to any “connected person”.

 

The capital received would be kept in an endowment and the Trustees could distribute interest in accordance with the new objects.

 

RESOLVED that the updated report be noted.
