Exclusion of the Press and Public That, in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they contain exempt information under paragraphs 1 and 2 of Part 1 of Schedule 12A of the Act, and it would not, on balance, be in the public interest to disclose the reports. Reconvened Appeal Against Dismissal on the Grounds of Redundancy Minutes: The Appellant supported by a Trade Union Representative attended the meeting. The Dismissing Officer, supported by the Assistant Head of People’s Services were also in attendance. A People’s Services Business Partner was in attendance to advise on matters of policy and procedure at the Committee. She had not taken part in the original decision. This was a reconvened meeting, both parties had presented their case. The meeting had been adjourned on 6th March 2014. It was understood that there had been ongoing without prejudice discussions but unfortunately the matter had not been resolved.
RESOLVED that:
1. Based on the information the Panel heard on 6th March 2014, and not withstanding some procedural difficulties, the Panel determined that the process followed was fair in all the circumstances. To the extent that there were any procedure issues, the impact that this would have had on the overall outcome was considered and that the appeal be dismissed. 2. Due to the way Payroll was administered, payment would have been received for the whole of April. The termination date was 25th April 2014 which had resulted in an overpayment of salary which may be offset against the redundancy payment.
