RESOLVED:  That Councillor Heffernan be elected Chair for the duration of the meeting.

5.

Appeal Committee Procedure Against Dismissal on the Grounds of Redundancy

Minutes:

RESOLVED:  That the Appeal Committee Procedure be noted.

6.

Exclusion of the Press and Public

That, in accordance with Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting for the following items of business on the grounds that they contain exempt information under paragraphs 1 and 2 of Part 1 of Schedule 12A of the Act, and it would not, on balance, be in the public interest to disclose the reports.

Minutes:

Appeal Against Redundancy

Minutes:

The Appellant, supported by a Trade Union representative, presented their case. The Dismissing Officer, supported by an HR Adviser, presented the case on behalf of the Authority. An HR Manager was in attendance to advise on matters of policy and procedure at the Committee. He had not taken part in the original decision. The Committee asked questions of both parties and the parties asked questions of each other. Both parties were given the opportunity to sum up their case. The Chair advised the Appellant that the additional information brought to the meeting, by way of a supplementary pack, would be taken from the hearing and progressed.

 

The Committee adjourned whilst deliberations took place regarding their decision.

 

RESOLVED:  That having heard the evidence provided by the Appellant and that provided by the Dismissing Officer, the Panel considered that the procedures had been applied correctly and the Appeal was therefore dismissed.

 

NOTE:

 

1. The Appellantwas advised that, if she remained aggrieved in relation to the detail that she had provided to the Panel in the supplementary pack, on workplace issues, she had the right to formalise this through the Council’s grievance procedure.
