DP/2026/01

The purpose of this report is to ask Members to review a dual driver licence where a conviction recorded against the licence holder calls in to question their fitness and propriety to be a suitable person to hold such a licence. As such, the licence holder has been referred to this Panel for determination.

The Panel considered an application to review a dual driver’s licence, due to a conviction recorded against the licence holder which calls into question their fitness and suitability to hold such a licence. As such, the application was referred to the Panel for determination.

 

RESOLVED that, based on the information provided to the Panel, having taken into account the reason the Driver had appeared before the Panel, namely an Adult Caution, the report written by the Officer, her recommendations, the Driver’s comments and the Council’s Statement of Fitness and Suitability, the Driver is not a fit and proper person and accordingly a written warning be issued to the Driver not to repeat the behaviour on the grounds that the offence was of a relatively low level nature relating to a family dispute and the Driver having had no previous history of complaints or convictions against him.

 

NOTE: The Driver attended the meeting and addressed the panel.

The purpose of this report is to ask Members to review a dual driver licence where information recorded against the licence holder calls in to question their fitness and propriety to be a suitable person to hold such a licence. As such, the licence holder has been referred to this Panel for determination.

The Panel considered an application to review a dual driver’s licence, due to information recorded against the licence holder which called into question their fitness and propriety to be a suitable person to hold such a licence. As such, the application was referred to the Panel for determination.

 

RESOLVED that, based on the information provided to the Panel, having taken into account the reason the Driver had appeared before the panel, namely the Driver’s conduct in being found with cannabis in the vehicle fuel cap of his vehicle and being due in court later this year for a drug driving offence, the report written by the Officer, her recommendations, the Driver’s comments and the Council’s Statement of Fitness and Suitability, the driver is not a fit and proper person and accordingly the licence is revoked with immediate effect on the grounds that the decision is in accordance with the Council’s Statement of Fitness and Suitability and the Driver had previously admitted that the drugs had belonged to him and he had admitted to smoking cannabis every two weeks. The Driver’s use of cannabis called into question the safety of his passengers whilst driving and therefore the licence is revoked with immediate effect on the grounds of public safety.

The purpose of this report is to ask Members to review a dual driver licence where information recorded against the licence holder calls in to question their fitness and propriety to be a suitable person to hold such a licence. As such, the licence holder has been referred to this Panel for determination.

The Panel considered an application to review a dual driver’s licence, due to information recorded against the licence holder which calls into question their fitness and suitability to hold such a licence. As such, the application was referred to the Panel for determination.

 

RESOLVED that, based on the information provided to the Panel, having taken into account the reason the Driver had appeared before the Panel, namely the Driver’s conduct in using a self defence spray against another person while driving their vehicle, the report written by the Officer, her recommendations, the Driver’s comments and the Council’s Statement of Fitness and Suitability, the driver was not a fit and proper person and accordingly the Driver be given a written warning not to repeat the conduct on the grounds that the police have confirmed the Driver acted in self defence and had taken no action. Also, the Driver had no previous complaints or convictions recorded against him.

DP/2026/05

The purpose of this report is to ask Members to review a dual driver licence where a conviction recorded against the licence holder calls in to question their fitness and propriety to be a suitable person to hold such a licence. As such, the licence holder has been referred to this Panel for determination.

The Panel considered an application to review a dual driver’s licence, due to a conviction recorded against the licence holder which calls into question their fitness and propriety to be a suitable person to hold such a licence. As such, the application was referred to the Panel for determination.

 

RESOLVED that, based on the information provided to the Panel, having taken into account the reason the Driver had appeared before the Panel, namely the Driver’s convictions for speeding, the report written by the Officer, her recommendations, the driver’s comments and the Council’s Statement of Fitness and Suitability, the Driver was not a fit and proper person and accordingly the licence be suspended with immediate effect for a period of three months on the grounds that since obtaining the licence in 2024, the driver had received three speeding convictions in less than 12 months despite receiving a final written warning before the Driver’s last conviction. The Panel considered that the speeding convictions call into question the safety of the Driver’s passengers and therefore the Driver’s licence is suspended with immediate effect on the grounds of public safety.

DP/2026/08

The purpose of this report is to ask Members to review a dual driver licence where a conviction recorded against the licence holder calls in to question their fitness and propriety to be a suitable person to hold such a licence. As such, the licence holder has been referred to this Panel for determination.

As such, the application was referred to the Panel for determination.

 

RESOLVED that, based on the information provided to the Panel, having taken into account the reason the Driver had appeared before the Panel, namely convictions for road traffic offences, the report written by the Officer, her recommendations, the driver’s comments and the Council’s Statement of Fitness and Suitability, the Driver was not a fit and proper person and accordingly be issued with a final written warning on the grounds that the decision is in accordance with the guidance in the Council’s Statement of Fitness and Suitability.

DP/2026/09

The purpose of this report is to ask Members to review a dual driver licence where a conviction recorded against the licence holder calls in to question their fitness and propriety to be a suitable person to hold such a licence. As such, the licence holder has been referred to this Panel for determination.

The Panel considered an application to review a dual driver’s licence, due to information recorded against the licence holder which calls into question their fitness and propriety to be a suitable person to hold such a licence. As such, the application was referred to the Panel for determination.

 

RESOLVED that, based on the information provided to the Panel, having taken into account the reason the Driver had appeared before the Panel, namely the Driver’s conduct, in that three separate complaints about their behaviour towards passengers had been received, the report written by the Officer, her recommendations, the Driver’s comments and the Council’s Statement of Fitness and Suitability, the driver was not a fit and proper person and accordingly the licence be revoked with immediate effect on the grounds that the complaints are from three separate women on different dates but are of a similar nature consisting of inappropriate remarks and behaviour. The Panel is satisfied on the balance of probabilities that the incidents occurred and consequently the decision is to revoke the Driver’s licence with immediate effect on the grounds of public safety.
