Albion Farm/The Turkey Shed The purpose of this report is to inform
members of an application for the grant of a premises licence in
respect of Albion Farm/Turkey Shed, Oldham Road, Delph, Oldham, OL3
5RQ which, due to representations being received, has been referred
to this Panel for determination. Additional documents:
Minutes: Consideration was given to a report which asked the Panel to determine an application for the grant of a premises licence in respect of Albion Farm/Turkey Shed, Oldham Road, Delph OL3 5RQ which, due to representations being received, has been referred to this Panel for determination.
The Panel were informed that, on 8th August 2025 the applicant, Jac Billington, applied for the grant of a premises licence for Albion Farm/Turkey Shed. The last date for representations in relation to this application was 5th September 2025. Representations had been received and were attached at Appendices 13.5 to 13.21 of the report.
The Panel were asked to consider amended operating hours which had been agreed with Greater Manchester Police.
The Panel were asked to consider the Authority’s Licensing Policy Statement. Their attention was drawn to Section 7, Prevention of Crime and Disorder, and Section 12, Public Safety, Section 13, Prevention of Public Nuisance and Section 15 Protection of Children from harm.
The Applicant attended and was represented and the Panel also heard from a representative of several objectors.
RESOLVED that the Licensing Panel have considered an application to vary the premises license for the Albion Farm/ Turkey Shed.
The Panel considered representations against the application relating to noise nuisance and the protection of children from harm.
The panel noted that the premises had operated since 2011 and that there had been no complaints received by the licensing section or the Environmental Health section in relation to noise complaints prior to an event held on 20th June 2025 in respect of which representations had been made. The Panel did not consider holding up to six outdoor events a year concluding at 10pm could be considered to engage the licensing objective relating to the protection of children from harm.
Having regard to the licensing objectives and in particular the prevention of public nuisance, the Panel considered that it was appropriate to grant the application with the amended operating hours but with the hours for live indoor music to be reduced as follows: Sunday – Thursday: 9:00am to 10:30pm Friday – Saturday: 9:00am to 12:30am.
In addition, the licence conditions should incorporate the new noise management policy including the creation of a WhatsApp group, the noise management risk assessment and the adoption of a licensing due diligence folder.
