Consideration was given to a report of the Principal Licensing Officer which asked the Panel to determine an application for a Temporary Event Notice for a birthday party up to 5am, at G1A Ground Floor, Ivy Business Centre, Crown Steet, Failsworth M35 9BG.


The Panel were informed that on the 10th May 2023 the applicant applied for a Temporary Event Notice at G1A Ground Floor, Ivy Business Centre, Crown Steet, Failsworth M35 9BG.  The last date for representations in relation to this application was 15th May 2023.  Representations had been received and were attached at Appendix 14.3 of the report.


The Panel were asked to consider the Authority’s Licensing Policy Statement.

Their attention was drawn to paragraph 8 - Public Nuisance.  They were also asked to consider the statutory guidance issued by the Secretary of State under Section 182 of the Licensing Act 2003.


The Panel were reminded that the steps available to them were:

a.    Confirm the notice as served on the Licensing Authority

b.    To reject the notice and issue a counter notice


The Applicant was in attendance.


The Panel heard from Environmental Health Service, who informed them that they have received complaints of noise nuisance of loud music from the premises and disturbances and suggested an earlier finishing time.


The Panel considered all the representations made by the applicant for the Temporary Event Notice and by the Environmental Health Service.  The Panel  noted that Greater Manchester Police would have no objection if the end time was modified to 3am to which the applicant agreed.  However, the Panel noted that the Environmental Health Service have received complaints of noise nuisance from the venue after previous events have been held going on until 4.15am.  Having regard to the four licensing objectives and in particular the prevention of public nuisance the Panel do not consider that it is appropriate to grant the Temporary Event Notice until 3am due to the effect on the residents’ of neighbouring properties.


RESOLVED that the application for the Temporary Event Notice is therefore REFUSED and a counter notice be issued.
