To consider the statutory report of the Monitoring Officer issued to all Elected Members.
Minutes: The Council considered a statutory report of the Monitoring Officer which addressed the continuing inability of the Council to appoint a Leader and establish a functioning administration and highlighted that this outcome is unlawful.
The Mayor, Councillor Byrne MOVED and Councillor Al-Hamdani seconded that Council resolves into committee in line with council procedure rule 12.4.4.(o) to allow officers to address the meeting.
On being put to the vote, the MOTION was CARRIED.
The Monitoring Officer and the Chief Executive addressed Council.
Councillors Shah, Quigg, Ghafoor, Al-Hamdani, Sharp, Williamson, E. Taylor, Chauhan, Byrne, Harkness, P. Taylor, Akhtar and Murphy addressed Council in relation to the report.
Councillor Woodvine MOVED and Councillor Chauhan seconded a closure motion.
On being put to the vote, the closure MOTION was carried.
RESOLVED: That Council agreed to receive the report and note the Monitoring Officer’s opinion.

Leader of the Council To elect a Leader of the Council, in accordance with provisions of the Local Government Act 2000 as amended Additional documents:
Minutes: Council considered a report of the Assistant Director of Governance which asked that consideration be given to a report regarding the appointment of the Leader of the Council, in accordance with the provisions of the Local Government Act 2000 as amended.
The Mayor, Councillor Byrne, MOVED and Councillor Ghafoor seconded a proposal to consider Amendment 7 first.
On being put to the vote, the MOTION was CARRIED.
Amendment 7 Councillor Hobin MOVED and Councillor Navesey seconded that Council suspend Council procedure rule 13.3
On being put to the vote, the MOTION was CARRIED.
Councillor Hobin MOVED and Councillor Navesey seconded an amendment to Amendment 7, nominating Councillor Brian Hobin to be appointed as Leader of the Council.
Councillor P. Taylor spoke on the amendment.
Councillor Hobin exercised his right of reply.
On being put to the vote, AMENDMENT 7 was LOST.
Amendment 1 Councillor Shah MOVED and Councillor E. Taylor seconded an amendment that Councillor Shah be appointed Leader of the Council and the Labour Group form a minority administration.
On being put to the vote, AMENDMENT 1 was LOST.
Amendment 2 Councillor Quigg MOVED and Councillor Paul Robinson seconded Amendment 2, that Councillor Lewis Quigg be appointed Leader of the Council.
Councillors P. Taylor, Kenyon, Eyre and Chauhan spoke on the amendment. Councillor Quigg exercised his right of reply.
On being put to the vote, AMENDMENT 2 was LOST.
Amendment 3 Councillor Barnes MOVED and Councillor Tarbuck seconded Amendment 3 Councillors Sharp, Hobin, E. Taylor and Ghafoor spoke on the amendment.
Councillor Barnes MOVED and Councillor Chauhan seconded a closure motion.
On being put to the vote, the CLOSURE MOTION was CARRIED.

The Mayor, Councillor Byrne, outlined that as all amendments had been lost, the Monitoring Officer would write to the Secretary of State for Housing, Communities and Local Government.
