The purpose of this report is to inform Members of an application for variation of a premises licence in respect of King William IV, 134 Chew Valley Road, Greenfield, Oldham, OL3 7DD which, due to representations being received, has been referred to this Panel for determination.

Consideration was given to a report of the Principal Licensing Officer which informed the Panel of an application for the variant of the premises licence in respect of King William IV, 134 Chew Valley Road, Greenfield, Oldham, OL3 7DD, that had been referred to the Panel for determination due to representations being received.

 

The Panel was informed that on the 24th May 2021, the applicant, Punch Partnerships (PTL) Limited, applied for the variation of a premises licence in respect of the premises at 134 Chew Valley Road. Following submission and advertisement of the application, a representation had been received from Oldham Council’s Environmental Health section on the 21st June 2021, opposing the grant of the application on the grounds of public nuisance. Representations had also been received from 10 members of the public against the application on the grounds of public nuisance. 13 representations of support had also been received on behalf of the application.

 

The Panel also be noted that, following consultation with Greater Manchester Police and the Licensing Authority the application had been amended to incorporate the conditions set out in section 4.3 of the report.

 

The Panel heard from Gary Maclean, Environmental Health Officer, that there were no concerns with the application. The applicant’s offer to close the outside bar area at 10.00pm was acceptable and therefore Environmental Health were happy with the application and the proposed conditions.

 

Members asked for and received clarification on the outside bar area. It was explained that the serving area was in a converted shipping container with server hatches which would allow customers to purchase drinks without going into the main bar area internally. £70,000 had been earmarked by the applicant for upgrades to the outside area if the application was approved. It was planned that serving would finish at 9.30pm with closure of the area at 10.00pm. Members also asked for clarification on the number of car parking spaces available on the premises. It was confirmed that currently the premises had 24 spaces that would be reduced to 12. The car park was mostly used by visitors to the park and cricket club as 85% of the visitors to the pub lived in the area and used other modes of transport.

 

The Principal Licensing Officer summarised the evidence and submissions. 

 

At this point in the proceedings the Panel, in accordance with Regulation 14 (2) of the Licensing Act 2003 (Hearings) Regulation 2005, moved into private session. In reaching a decision the Panel took into account the relevant provisions of National Guidance and the Council Licensing Policy Statement with reference to the prevention of crime and disorder, public safety, prevention of public nuisance and protection of children from harm.

 

RESOLVED that, having considered the representations from the Licensing Authority and having considered the Licensing Objectives with particular reference to public nuisance, the premises licence would be granted subject to the additional conditions agreed by the applicant and Greater Manchester Police as detailed in paragraph 4.3 of the report and  ...  view the full minutes text for item 7
