Proposed New Saddleworth School

Minutes:

 

The Group Solicitor reminded Members of the Committee that the planning applications before this meeting needed to be considered afresh. Members were advised to disregard any previous decisions made and that applications were to be determined on planning merits only.

 

The Group Solicitor proceeded to inform Members about a letter the Council had received that afternoon from Irwin Mitchell Solicitors, acting on behalf of Diggle Action Group, which urged the Committee to refuse approval to the four planning applications on the agenda, on the basis of what were alleged to be legal flaws in the Planning Officer’s report.

 

The Group Solicitor then provided Members with advice dealing with the alleged legal flaws highlighted in the letter that had been obtained from David Manley QC, who had been advising the Council on the handling of the planning applications.   

 

 

C. APPLICATION NUMBER: PA/337301/15

 

APPLICANT: Interserve Construction Ltd on behalf of the Secretary of State for Education

 

PROPOSAL: a full planning application to build a new secondary school and associated facilities.

 

LOCATION: Former WH Shaw Pallet Works, Huddersfield Road, Diggle, OL3 5NX

 

It was MOVED by Councillor Bashforth and SECONDED by Councillor Blyth that the application be APPROVED.

 

On being put to the vote 12 VOTES were cast IN FAVOUR OF APPROVAL and 1 VOTE was cast AGAINST with 0 ABSTENTIONS.

 

DECISION: that the application be GRANTED subject to the conditions as set out in the report and the amended conditions included in the Late List attached at Item 6.

 

NOTES:

1.    That the Objector and the Applicant’s Agent attended the meeting and addressed the Committee on this application.

2.    In reaching its decision, The Committee took into consideration the information as set out in the Late List attached at Item 6.

APPLICANT: WRT Developments Ltd

 

PROPOSAL: A full planning application to demolish the existing buildings on the WH Shaw site within the red line boundary. It does not include the grade II listed office building and clock tower or link bridge.

 

LOCATION: Former WH Shaw Pallet Works, Huddersfield Road, Diggle, OL3 5NX

 

It was MOVED by Councillor Bashforth and SECONDED by Councillor Blyth that the application be APPROVED.

 

DECISION: that the application be GRANTED subject to the conditions as set out in the report and the amended conditions included in the Late List attached at Item 6.

 

 

 

NOTES:

1.    That the Objector and the Applicant’s Agent attended the meeting and addressed the Committee on this application.

2.    In reaching its decision, the Committee took into consideration the information as set out in the Late List attached at Item 6.

3.    The Chair reported that the Members of the Committee had attended a site visit on 12th April 2016.

APPLICANT: WRT Developments Ltd

 

PROPOSAL: a listed building consent application to demolish the link bridge attached to the Grade II listed office building and clock tower.

 

LOCATION: Former WH Shaw Pallet Works, Huddersfield Road, Diggle, OL3 5NX

 

It was MOVED by Councillor Mushtaq and SECONDED by Councillor Fielding that the application be APPROVED.

 

DECISION: that the application be GRANTED subject to the conditions as set out in the report and the amended conditions included in the Late List attached at Item 6.

PROPOSAL: a full planning application to provide a parental drop off facility plus residential car parking as part of the wider highways scheme on land off Huddersfield Road.

 

LOCATION: Former WH Shaw Pallet Works, Huddersfield Road, Diggle, OL3 5NX

 

It was MOVED by Councillor Bashforth and SECONDED by Councillor Blyth that the application be APPROVED.

 

On being put to the vote, 12 VOTES were cast in favour of APPROVAL and 1 VOTE was cast AGAINST with 0 ABSTENTIONS.

 

DECISION: that the application be GRANTED subject to the conditions as set out in the report and the amended conditions included in the Late List attached at Item 6.
