It was MOVED by Councillor Williamson and SECONDED by Councillor Blyth that the application be REFUSED (against officer recommendation) on the grounds of impact to local amenities and the impact to highways.

 

On being put to the vote, 3 VOTES were cast IN FAVOUR OF REFUSAL and 11 Votes were cast AGAINST. The motion therefore fell.

 

It was MOVED by Councillor Ball and SECONDED by Councillor Houle that the application be GRANTED.

 

On being put to the vote, 11 VOTES were cast IN FAVOUR OF APPROVAL and 3 Votes were cast AGAINST.

 

DECISION: That the application be GRANTED as recommended subject to; the conditions as set out in the report; the amendment to condition 2 as detailed in the Late List, and; the addition of conditions 12, 13, 14, 15 and 16 as detailed in the Late List.

 

NOTES:

1. An Objector, the applicant and Councillor J Dillon in his capacity as a Ward Councillor, attended the meeting and addressed the Committee on this application.

2. In reaching its decision the Committee took into consideration the information as set out in the Late List attached as Item 14.

It was MOVED by Councillor Wrigglesworth and SECONDED by Councillor Houle that the application be APPROVED (against officer recommendation), subject to conditions regarding; the development to commence within 3 years; being in accordance with amended plans; traffic, car parking spaces, and parent drop-off in accordance with plans; boundary treatment scheme; materials to match in bricking up some openings, and; the possible hours of use to be 7.00 – 20.30 Monday – Saturday, and no hours on Sunday.

 

On being put to the vote, 14 VOTES were cast IN FAVOUR OF APPROVAL.

 

DECISION: That the application be GRANTED (against Officer recommendation) with the following conditions:-

 

1. The development must be begun not later than the expiry of THREE years beginning with the date of this permission.

Reason - To comply with the provisions of the Town & Country Planning Act 1990, as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

 

2. The development hereby permitted shall be fully implemented in accordance with the approved plans and specifications, received on 13 September 2012 and 6 December 2012, which are referenced as Drg No. IVY 001 Rev B, IVY 002 Rev E and IVY 003, unless otherwise agreed in writing by the Local Planning Authority. 

Reason - For the avoidance of doubt and to ensure that the development is carried out in accordance with the approved plans and specifications.

 

3. The materials to be used in the construction of the external surfaces of the development hereby permitted shall match those used in the existing building.

Reason - To ensure that the appearance of the existing building is not detrimentally affected by the proposed extension.

 

4. The development hereby permitted shall not be brought into use unless and until the car parking spaces and parent drop off facility have been provided in accordance with the approved plan received on 6th December 2012 (Ref: Dwg No. IVY002 Rev E) and thereafter the parking spaces shall not be used for any purpose other than the parking and manoeuvring of vehicles.

Reason - To ensure that adequate off-street parking facilities are provided for the development so that parking does not take place on the highway to the detriment of highway safety.

 

5. No development shall take place unless and until there has been submitted to and approved in writing by the Local Planning Authority a plan indicating the positions, design, materials and type of boundary treatment to be erected (such scheme to include any subsequent amendments as required by the Authority).  The boundary treatment shall be completed before the use hereby permitted is commenced.  Development shall be carried out in accordance with the approved details.

Reason - To ensure an acceptable form of development is achieved in the interests of amenity as such details were not submitted with the application.
